FILL OUT SUMMONS

  1. You are the Plaintiff they are the Defendants.
  2. If you do not pay  the $402 filing fee your chances of being dismissed for the smallest mistakes are much greater.
  3. You can not sue a state agency or government agency under section 1983 you can only sue a person, human being, state official in their individual capacity.
  4. ABSOLUTELY DO NOT TELL THEM THAT YOU ARE SUING!
  5. DO NOT EDIT YOUR COMPLAINT MORE THAN 1X BEFORE 30 DAYS!
  6. If your case is still open at the state level do not serve them at the CPS office only serve the attorney general of your state.
  7. They will retaliate and keep your child longer if you threaten to sue them
  8. The only person you will tell is the attorney general, that is not involved in your case.
  9. Fill one out for social worker and one for supervisor send both of those in with your complaint when you send it in.
  10. Their address will be the address to the CPS office only.
  11. This is what the clerk will mail back to you with the official seal.
  12. After you get this document in the mail you can now serve the attorney general of your state. If you decide to do this via postal mail make sure it is certified and you get a receipt they received it.
  13. Do not assume they are sued when you mail this in you MUST wait for the stamped version and signed by the clerk to mailed back to you!
  14. The AAG of your state will beg you not to tell the SW or anybody at CPS so they can investigate they do not want you using your lawsuit as a weapon against CPS. If you do the AAG may get the judge to dismiss your case for harassment using litigation.
